How can I collect what I am rightfully owed?

Q: I have customers that are either not paying on time or only making partial payments. How can I collect what I am rightfully owed?

A: This type of scenario is unfortunately a sign of the tough economic times. Businesses extend more credit in order to generate more sales, but that comes with a high element of risk. The cash flow of your business can become seriously affected when that credit is not paid back on time. If this is becoming an issue for you, it may be time to look at your credit policies, as well as putting a collection procedure in place that nips slow payment in the bud.

The first thing you need to do is take a look at your accounts receivable to get an idea of what is current, what is slightly overdue, what may be collectible with a little prompting, and which accounts are effectively as good as written off. If you find any in the latter group, think about handing the accounts over to a collection agency so that you can focus on those that you may be able to collect on. The accounts that you deem to be collectible, but which are past due, need you immediate attention. Before you take action, though, you need to ensure that you are in compliance with the Fair Debt Collection Practices Act. If you are unaware of the details of said act, please refer to the Federal Trade Commission at http://business.ftc.gov/credit-and-finance/debt-collection for further information.

It is never easy to contact customers delinquent in their payments, but it is necessary. You need to be able to put aside relationships and potential future business so that you can focus on getting paid what you are owed. Talking to the customer personally is often enough to get the ball rolling on a past due account. It is not always negligence on the part of the customer, and it can sometimes be a technical glitch or some other issue that is at fault. If it does turn out that the customer is experiencing a temporary cash flow situation, you may still be able to work out a payment plan that is equitable to you both. That said, an agreement has to be reached and agreed to when following this route. It also has to be made clear to the customer that any sales taking place before the full amount is paid will be done on a COD basis only. Most customers will happily honor this type of agreement, but those that don’t will then have to be transferred to debt collections.

The final step in the process involves putting together a detailed credit sales policy. Decide which customers are eligible for credit and consider the length of time that is allowed before payment is due. An option that can be used here is to offer a discount to those customers that pay ahead of the due date. On the flipside, you may also consider adding late payment charges for those that slip past the due date, keeping in mind that there are laws in place that dictate how much can reasonably be charged. With the massive volume of change, and the enormous legal foundations that are changing, we are again feeling very hopeful for our industry.

The Need for Consumers To Repay Their Debts

No matter where you stand in the political spectrum, you have to agree with the President.

There does need to be a balance that respects that those in debt, should pay their debt, and there needs to be a balance in how the debt is collected.

How Do I Collect on my Customer Debt?

Small to mid sized business will almost always face the question, how do I deal with customers not paying their bill.


During this last recession, the issue of past due debt has been on the table, perhaps more than at any time in history

Here's Collectivty LLC's suggestion:

1.  Divide up your past due debt into 3 categories.

  • Collectible, but a little past due
  • Collectible, but requires effort
  • Probably not collectible.


Collecting what you are owed
Your first step is to stop draining life out of your business.  The last category, Probably not Collectible, ditch it.  Write it off, give it to a debt collection agency like Collectivity, and move on.   Spending huge effort tyring to collect on a debt not only draws resources away from your core business, it might also lead you down a very difficult path, where the debtor often has more rights than the creditor.  It sounds backwards, but truly, a misstep in the collection process can lead to you actually owing money in fines and penalties for improperly collecting a debt.  It's not worth the focus, write it off, hand it over.

For the first group, debt that is just a little past due, these are the debts that require immediate attention.  These are the most collectible.  The further away you are in time from when a debt was incurred, the less likely it is to collect.  The epole that are only a little past due, can usually be nudged back on track with a simple, personal phone call.  If anything that will help you determine if they will fall incategory 2 or 3, and allow you to move on quickly.

For anything more than an invoice, and a phone call, be sure to read up on the Fair Devbt Collections Act.  This is the main body of rules governing the collection of debt.  I mention many times that a misstep in the collections process can end you up in court with the people you owe money to, sueing YOU for unfair debt collections.  Thousand dollar fines are not unusal.

For the second group of people that owe you money, some suggestions we might put forward is to work out a payment plan, and understand that these folks are probably hurting the way you are.  Be reasonable and understanding, have empathy, but be firm.  Most importantly get some form of commitment from them, some form of forward action acknolwedging that the debt is thiers, its legitimate, and have some forward motion on getting at least a minor payment.   If the debt ever does get turned over to us for collections, any of these things will help us in getting back what you are owed.

It is very important that if you think someone is moving from collectibel, but requiring effort, to probably not collectible, you stop the bleeding.  Cut them off.  Make future purchases COD, or Cash On Delivery.  Do not throw good money after bad.  Cash Flow is the lifeblood of your business.

Some good ideas for small businesses is to have a clear policy on extending credit, including every step to go through as you go from quick payment, to slow payment, to very delinquent.  Stand By Your Policy, enforce it.  Check customers credit before extending credit, or at least before extending large amounts of credit.  Offer an incentive to pay early to get quick pay clients quicker, and offset some of your slow pay cash flow drain.  If incentive is the carrot, don't forget the stick, and have late payment penalties.  Make sure your clients are aware of your credit policy, so that they know the rewards, and cost of conforming, or not conforming to your credit policy.

Ft. Lauderdale Debt Collectors

Florida is a wonderful place to live, and own a business.  I'd like to start a small series on the cities in Florida that we serve.  A thorough understanding of what makes a city tick, helps us to be more effective serving our clients, in those cities.  It also helps us to better relate to, and work with, debtors from whom we are trying to collect.

More than ever, you need professionals to collect debt.

Greetings and Good Morning.

I've been mentioning the incredible changes to the debt collection industry in terms of large wholesale changes to the rules that govern the collection of debt.

When I talk to my piers, friends and associates in the industry I get a puzzling and near universal attitude of "glumness" that "THEY"  in this case our legislatures, are making it impossible for "US",  the debt collectors, to do our jobs.

We could not hold a more polar opposite view  from our associates in the debt collection industry.  

  • First, it is not the business of our government to protect our jobs, not in in any industry, from our own unscrupulous practices.
  • Second, there is a huge segment of our industry that believes that if they know how to run a phone center with a calling script, they have all it takes to be collectors.
  • Third, legitimate debt collection professionals may have more legal oversight, but they were probably already acting in their professional capacity in a way that is not in conflict with existing, and upcoming laws.
  • Fourth, our industry is about to be faced with a  massive new wave of clients, and most of our industry is unprepared..    
  • Fifth, with greater oversight and legislation the goons thugs and heavy handed "bottom end" of our industry will by necessity "go away" and our industry will finally enjoy the credibility as a necessary partner between commercial business, and clients having difficulty, providing the oil that feeds the economy ensuring that everyone gets paid for their effort.


Let's draw a parallel, regardless of party affiliation, the Affordable Care Act has created a massive glut of patients that in the past could not afford healthcare, that are now knocking on the doors of healthcare providers.  The healthcare industry was totally unprepared for the sudden new demand.  I believe that my industry, the debt collection industry, is about to be inundated with more demand.  The small to mid sized business owner that in the past conducted all of their own accounts receivable collections is not a collection professional.  They are going to find it more and more difficult to collect a debt legally, they may even lose a few opportunities in court due to missteps.

Small businesses and mid sized businesses today simply do not have the knowledge resources to keep up and stay compliant with the changing legislation around what you can and cannot due to collect a debt.   Today's business is totally unprepared for the dithering amount of collections laws, and face a staggering array of consequences for innocent missteps.   

We have heard reports of Credit Card companies walking away from literally billions of dollars in past due debt without legal action, because it is too difficult to legally collect without countersuit.  How is the small business person to collect their legitimate debts without help.

I've said many times, that our industry is on the verge of a renaissance.  Where goons and thugs go away, where legal and psychological professionals begin engaging in a rational process of collecting debt in a firm, respectful, and fair way.  There is a new breed of professional required in our industry.  Like the medical profession, where a wave of demand caught them unawares, I fear that there are far to few debt collection professionals out there that are embracing the current change, and far to few that are ready to support this new wave of small to mid sized businesses that are no longer able to keep up with what it takes to legally collect on the money they are legitimately owed.

Just today, new court decisions on how you have to word collection of "old debt"  How in the world is a construction company supposed to keep up with this?   We, as an industry are more vital, needed, and relevant than ever.

Found an interesting Paper/Article

Good Morning everyone!

Debt Collection musings, humor, bric a brac...

Today falls under serendipity.  Serendipity is when you find an unexpected treasure that fills you with delight.

My serendipity today is in the form of a delightful article I literally stumbled across.  All I know about its authorship is that it was written by someone named Hoffman, and was written for St. Louis School of Law.

The article, in typical dull scholarly fashion is entitled

I don't miss college for  its requisite dullness!

This person, professor ?  student?  has managed to capture the essence of the intent of the FDCPA, and how it has been misused.  They have captured the integrity and necessity of the debt collection industry, and given appropriate caution to the strong arm tactics that are an embarrassment to our industry.

All in all, I think I could have written this paper when I was in school.  It is about the need for a new paradigm in debt collection.  The dead beat debtor is for the most part a minority of the actions we are involved in.  Most are honest hard working folks, that have fallen behind, and need our help to get back on track.  Debtors treated firmly, and with respect.

My hats off to this person "Hoffman".   We seem to be of the same belief system that the debt collection agency profession is a vital part of the economic ecosystem.  That old school strong arm tactics need to be addressed, and buried, and never appear again, that debt collection laws and practice need to reflect a more enlightened attitude toward the three parties involved.  The creditor, the debtor, and the debt collection professional.

The New Wave of Debt Collection Professionals

Didn't we just finish saying that the debt collection industry is in desperate need of a total overhaul, that the abusers in the system cannot be tolerated, and that the future of debt collection relies on:


  • 1.  Acknowledging that the debtor has a moral obligation to pay their debt.
  • 2.  Debtors should be treated firmly, but with respect.
  • 3.  The new debt collector must have a background in law and psychology
  • 4.  There is no room for the "goons and thugs" of yesterday

Don't get bogged down with old school goons like these reported in Buffalo.  You will irevocably damage your business reputation through association, when the debtor turns around and sues, you will end up with nothing but litigation fees.
